These Terms set out your rights and responsibilities when using the Mathskitchenfe.co.uk website.

The rights you always get by law when you buy goods and services (‘consumer’ or ‘statutory’ rights) aren’t affected by these Terms.

When you use or visit our website, you agree to be bound by and follow these Terms.

1. Introduction

1.1 If you use the site you agree to be legally bound by this contract.

1.2 This contract sets out:

1.2.1 your legal rights and responsibilities;

1.2.2 our legal rights and responsibilities; and

1.2.3 certain key information required by law.

1.3 You may only use the app for teaching or learning reasons

2. Use of the site by minors

2.1 Minors (below the age of 16 years of age) should have the consent of their parent, guardian or teacher / course leader (acting as in loco parentis) to use the site.

3. Your privacy and personal information

3.1 Our Privacy Policy is available at https://mathskitchenfe.co.uk/privacy-policy/

3.2 Any personal information that you provide to us will be dealt with in line with our Privacy Policy. The policy explains what personal information we collect from you, how your data is processed and why we collect and store your data as well as your rights in relation to your personal information and how to contact us in the event you have a query or complaint about the use of your personal information.

4. Limit on our responsibility to you

4.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for:

4.1.1 losses that:

4.1.1.1 were not foreseeable to you and us when the contract was formed; or

4.1.1.2 that were not caused by any breach on our part;

4.1.2 losses to non-consumers

4.2 The information which we provide to individual users is not intended, and must not be interpreted as a guarantee of a pass for a particular Functional Skills Maths qualification.

5. Disputes

5.1 We will try to resolve any disputes with you quickly and efficiently

5.2 If you are unhappy with the service to you, or any other matter, please contact us as soon as possible at info@mathskitchen.com

5.3 If you want to take court proceedings, the relevant courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.

5.4 The laws of England and Wales will apply to this contract.

6. Third party rights

6.1 No one other than a party to this contract has any right to enforce any term of this contract.

7. Your obligations

7.1 Any content, including the code that is on the Mathskitchenfe.co.uk website may not be:

7.1.1 copied by you;

7.1.2 changed by you (which means, in particular, that you are not allowed to adapt, reverse-engineer or decompile it, or try to extract the source code from it, except where any of this is allowed by law);

7.1.3 combined or merged with, or used in, any other computer program;

7.1.4 distributed or sold by you to any third party.

7.1.5 disassembled, decompiled or reverse engineered.

7.2 You must keep your username and password confidential. You may not share them or share access to your account with anyone except your parents/guardians.

7.3 Any Access Code, which is dispensed by us to you as a Teacher/Course leader, or by your Teacher/Course leader to you as a Student/Learner may only be shared with current students/learners in your group, in you organisation. An Access Code may not be given to students outside of your organisation or to any third party.

8. For Teachers/Course Leaders and Students/Learners

8.1 Students/Learners will be one of your Organisation’s ‘End Users’ and these Terms will act as an End User License Agreement (‘EULA’) between us and students for your use of the Members' content.

8.2 The Organisation account allows access to the ‘Teacher Dashboard’ for Teachers/Course Leaders and to Members' content for Students/Learners.

8.3 Your organisation may have accepted a special set of terms and conditions relating to its and your use of the subscription. Those terms and conditions state that if you or any other Teacher/Course Leader or Student/Learner of the organisation misuse the Members' content or breach these Terms, we may suspend or cancel your access or the whole organisation’s access to the content
